1. Acceptance of Terms
By accessing or using the Indoma clinical care platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including healthcare providers, administrators, and staff members.
2. Description of Service
Indoma provides a clinical care management platform that enables healthcare providers to manage patient records, schedule sessions, document clinical encounters, record and transcribe audio, and collaborate with care teams. The Service is available via web and mobile applications.
3. User Accounts
- You must be invited by an authorized administrator to create an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must immediately notify us of any unauthorized use of your account.
- You may not share your account or authentication codes with others.
- You must provide accurate and complete information when using the Service.
4. Acceptable Use
When using the Service, you agree to:
- Use the Service only for lawful clinical care purposes.
- Comply with all applicable healthcare laws and regulations, including HIPAA.
- Obtain appropriate patient consent before recording audio sessions.
- Not attempt to access data belonging to other organizations.
- Not reverse engineer, decompile, or disassemble any part of the Service.
- Not use the Service to store or transmit malicious code.
5. Patient Data and Privacy
You acknowledge that the Service processes Protected Health Information (PHI) and agree to handle all patient data in accordance with HIPAA and other applicable privacy regulations. Our handling of data is further described in our Privacy Policy.
6. Intellectual Property
The Service, including its design, features, and content (excluding user-generated clinical data), is owned by Indoma and protected by intellectual property laws. You retain ownership of all clinical data you enter into the Service.
7. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for any temporary unavailability due to maintenance, updates, or circumstances beyond our control.
8. Limitation of Liability
The Service is a tool to assist healthcare providers and does not constitute medical advice. Healthcare providers are solely responsible for clinical decisions made using the Service. To the maximum extent permitted by law, Indoma shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
9. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Data export options will be made available in accordance with applicable regulations.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
